Terms of Service

§1 GENERAL PROVISIONS

The online store www.jokerwear.pl operates under the terms and conditions set out in these Terms and Conditions. These Terms and Conditions specify: the rules for concluding and terminating Product Sales Agreements, the complaint procedure, the types and scope of services provided electronically, and the terms and conditions for concluding and terminating agreements for the provision of electronic services. Each Customer, upon commencing use of the Store's services, is obligated to comply with the provisions of these Terms and Conditions. In matters not regulated by these Terms and Conditions, the provisions of, among others, the Act of 18 July 2002 on the provision of services by electronic means; the Act of 30 May 2014 on consumer rights; the Act of 23 September 2016 on the out-of-court resolution of consumer disputes; and the Act of 23 April 1964 – the Civil Code – apply.

§2 DEFINITIONS

Order form – an interactive form on the website www.jokerwear.pl enabling you to place an order.
Customer – a natural person who is over 18 years of age and has full legal capacity, a legal person or an organizational unit without legal personality that may acquire rights and incur obligations in its own name.
Consumer – a natural person performing a legal act not directly related to his or her business or professional activity.
Seller – Łukasz Wenckowski, conducting business activity under the name ŁUKASZ WENCKOWSKI CUSTOM HAFT, with its registered office at 3 Żytnia Street, 72-300 Jabłonowo, NIP: 8571939111, REGON: 528218262.
Product – a movable item available in the Store that is the subject of the Sales Agreement.
Price – the value expressed in Polish zloty (PLN) that the Customer is obliged to pay to the Seller for the Product.

§3 PRODUCT INFORMATION AND PLACING ORDERS

The Store sells Products online. All Products are new, compliant with the contract, and legally placed on the market. The information contained on the Store's website does not constitute an offer within the meaning of the law, but rather an invitation to enter into a contract. The price listed on the website includes all components but does not include delivery costs. Orders can be placed online 24 hours a day. Acceptance of the Terms and Conditions is a condition for placing an order.

§4 CONCLUSION OF THE SALES AGREEMENT

The Sales Agreement is concluded after the Customer places an order and the Seller confirms its acceptance. Confirmation of order acceptance is sent electronically. Upon receipt of the email confirmation by the Customer, the Sales Agreement is concluded.

§5 PAYMENTS

The Seller provides the following payment methods:

  • traditional transfer to bank account no. 44 1090 2835 0000 0001 5770 6694 (Santander Bank),
  • electronic payment (payment card, BLIK, Przelewy24, PayPal).

Please include your order number in the transfer description. The customer is obligated to make payment within one business day of concluding the contract. Order processing will begin once payment has been received.

§6 DELIVERY

Delivery costs are covered by the Customer and are visible when placing the order.

  • 2–7 business days (if product is in stock),
  • 2–10 business days (if the product is made to order),
  • 3–10 business days (for individual projects).

Delivery is carried out via Poczta Polska or a courier company within Poland.

§7 COMPLAINTS

The consumer has the right to file a complaint regarding the non-conformity of the Product with the contract. Complaints can be submitted via email to jokerwear.haft@gmail.com . The complaint should include a description of the problem, the date of the non-conformity, and contact information. The Seller will review the complaint within 14 days. If the complaint is justified, the Seller will:

  • covers the costs of repair, replacement and re-delivery,
  • reduces the price or refunds the price in the event of withdrawal from the contract.

The Consumer is obliged to make the Product available to the Seller – collection takes place at the Seller's expense.

§8 WITHDRAWAL FROM THE CONTRACT

The consumer may withdraw from the contract without giving any reason within 14 days. In the event of withdrawal, the contract is deemed null and void. The Product must be returned no later than 14 days from the date of submission of the declaration of withdrawal. Refunds will be made no later than 14 days from receipt of the return or confirmation of its return. The consumer is responsible for any diminished value of the Product. The right of withdrawal does not apply to custom-made products. Orders cannot be canceled once the graphic design has been initiated. In the event of cancellation of the design, a PLN 70 fee will be charged. If the incorrect size or product type is selected, returns or exchanges are not possible.

§9 ELECTRONIC SERVICES

The Service Provider allows for the submission of orders electronically. This service is provided free of charge. The agreement for the provision of electronic services expires upon placing or discontinuing the order. Technical requirements: a device with internet access, a browser with cookies and JavaScript enabled. The Customer is obligated to use the Store in accordance with the law and good practices.

§10 PERSONAL DATA

The personal data administrator is Łukasz Wenckowski. Personal data is processed in accordance with the Privacy Policy available on the Store's website.

§11 COMPLAINTS ABOUT ELECTRONIC SERVICES

Complaints can be submitted to: jokerwear.haft@gmail.com . The complaint should include a description of the problem and contact information. The Service Provider will review the complaint within 14 days.

§12 FINAL PROVISIONS

Contracts are concluded in accordance with Polish law. In the event of a dispute, the parties will attempt to resolve the dispute amicably. Consumers may seek assistance from the municipal consumer ombudsman or the ODR platform: http://ec.europa.eu/consumers/odr/ . If an amicable resolution to the dispute is impossible, a common court will have jurisdiction in accordance with the provisions of the Code of Civil Procedure.

§13 ADDITIONAL INFORMATION

Once work on the graphic design has begun (e.g., embroidery visualization, photo editing), the order cannot be canceled or edited. If the customer decides to cancel the order after receiving the design but before the embroidery is completed, a refund is possible, less the cost of preparing the graphic design in the amount of PLN 85. All embroidery is handmade, custom-made, in accordance with the customer's specifications. The colors visible on the website may differ slightly from the actual ones due to individual monitor and screen settings. We make every effort to reproduce colors as accurately as possible. If the customer selects the wrong size or type of clothing, exchanges or returns are not possible. Please make your purchase decisions carefully – if in doubt, please contact us before finalizing your order. Pursuant to Article 38, Section 3 of the Act of 30 May 2014 on Consumer Rights, the right of withdrawal does not apply to products made to special order, i.e., tailored to the customer's individual needs.

The regulations are effective from September 1, 2025.
